Miller Homes Limited, First Floor, Miller House, 2 Lochside View, Edinburgh Park, EH12 9DH Edinburgh ("Miller Homes" or "we") is the controller of your personal data. We respect your privacy and are committed to protecting it.
We recognise that when you choose to provide us with information about yourself, you trust us to act in a responsible manner.

This Privacy Policy applies to information processed by Miller Homes and its group of companies, including St Modwen Homes Limited, a Miller Homes brand. This Privacy Policy will inform you of how we manage and protect data and of the choices you can make about the way your personal information is collected by us. Personal information is the information that identifies a living individual or which could, with other information that we hold, identify that individual. It includes your name and contact details, but also includes other information that is relevant to you such as your preferred property or development.

1. What personal information does Miller Homes collect?

a) Information we collect
We will collect information about your visit to our website. This may include your IP address (this is the number that is automatically assigned to your computer when you are online); operating system, browser type and device used to access the website; when and how you accessed the website; and if you joined the website from another website.
Cookies may be used to store some of the information collected during your visit to our website. These are small files that are stored on your computer when you visit a website. For example, they allow the website to remember the log in details for your account.

We also operate CCTV in our premises and we will collect CCTV images if you attend our premises where this is used.
We may also collect your personal information from third parties, for example from estate agents, or from social media with your consent. We also may contact third parties such as your solicitor, or financial advisor, as part of the purchase process, as detailed in section 2 (c) below.

b) Information you provide
You provide us with your personal information when you make enquiries or register on our website, or when you contact us by phone, e-mail, make a visit to our sales offices or complete an application form. This may include your name and address and details of which properties and/or developments are of interest to you or further information necessary to assist with a specific enquiry. Further information will be required from you if you decide to reserve and purchase a home. This will include information that we require to undertake anti-money laundering checks, financial details about your purchase including evidence of the source of funds and information about the sale of your current property (if relevant). If you are applying to the First Homes Scheme, we will also ask you to provide information regarding your income and expenditure.

c) Information contained in any communication
We may combine information obtained from cookies with information you give to us to determine which type of property or development you are most interested in. We will use this combined information for the purposes set out below (depending on the types of information we receive).

2. How does Miller Homes use your information?

Miller Homes will use your information for the following general purposes:

i. to provide you with information that you have requested;
ii. to inform you about relevant Miller Homes’ developments;
iii. to process and complete the reservation and purchase contract once you have chosen to reserve and purchase a home from Miller Homes;
iv. to process payments from and refunds to you;
v. to provide you with customer services after you have purchased a property, including but not limited to our emergency repair service and out of hours helpline;
vi. for our internal purposes such as data analysis, research, surveys, for administering our website and to improve the quality of our customer service;
vii. to measure or understand the effectiveness of advertising we serve to you and others, and to send relevant advertising to you;
viii. to process applications for the First Homes Scheme;
ix. for compliance and crime prevention purposes, including anti money laundering checks; and
x. to conduct competitions or marketing/advertising campaigns and activities.

In particular, Miller Homes will use your personal information in the following ways:

a) When you make an enquiry to Miller Homes or register online
We will use this information in order to respond to your enquiry. We may also use your contact information to let you know about developments, news, events or special offers which may be of interest to you as set out in section 2 (b) below.
We may use a third party to keep a record of any call you make to us so that we are able to return your call. By calling us or asking us to call you, you acknowledge that we may contact you by telephone on the number you have called us from for the purposes of discussing developments with you.
We may monitor, record, store and use any telephone, email or other communication with you in order to check any instructions given to us.

b) When Miller Homes wishes to communicate with you
At several points throughout the website, you may be given the option to receive occasional information on Miller Homes' or St Modwen Homes’ developments, future developments, special deals and updates. We may contact you by phone, SMS, email or post for this purpose. You can let us know your contact preferences by registering for an online account on our website.
If you do not want to be contacted for this purpose, all e-mails will include an “unsubscribe” option allowing you to let us know that you no longer wish to receive any further messages from Miller Homes. For more details about how to unsubscribe, please see section 7 (b) below.

c) When you reserve or purchase a home
When you reserve a home, we will collect additional information from you in order to undertake our anti-money laundering checks, to process your reservation fee, to issue a contract and to complete the sales process.
During the sales process, we will use your data to keep in touch with you and inform you of progress with your purchase and the build status of your home. We will communicate with your solicitors and, with your permission, your independent financial advisor.
We will also share your information with third parties as part of the purchase process. This will include third parties who we instruct to conduct anti-money laundering, source of funds or credit risk checks on our behalf, managing agents/factors, NHBC and other warranty providers for whitegoods. We may also share your information with utility providers for connection of services like gas and electricity, with Help to Buy or Own New Schemes, with WorldPay when processing payments and refunds, our appointed solicitors and your appointed solicitors and once you have purchased your home sub-contractors or suppliers to carry out our post purchase customer services including out of hours contact.
We will also collect information from you when you use our post purchase Recommend a Friend scheme.

d) When you apply to the First Homes Scheme
In addition to the information collected under 2(c) above, when you apply for the First Homes Scheme, we will collect personal information from you from the application form in order to progress your application. 
As part of the First Homes Scheme process, we will share your information with third parties. In particular, your personal information will be submitted to the local authority who is responsible for deciding the outcome of your application. Your personal information may also be shared by the local authority with the UK Government Department for Levelling Up, Housing and Communities (DLUHC), as detailed in the “Your data” section of the First Homes application form.
We may also share your information with independent financial advisors. 

e) When you enter a competition or marketing campaign
When you enter any competition, advertising campaigns, marketing or promotional activity with Miller Homes or St Modwen Homes, you may provide us with your personal information. You should be aware that any personal data you provide about you, any children or any other person(s) in any text, image, posts, photo or video, including your name, the relevant development and your location in connection with that competition or marketing campaign will be used in internal and external publications, and may be published on social media platforms and posts, or online and paper based campaigns. Prize-winner’s surname and country location will be made available on request in accordance with the CAP code and the Campaign terms and conditions.
Items posted on social media may be accessible in different countries that do not have laws with the same level of protection for your personal data as in the UK. You should only provide personal data that you and other individuals in those items are comfortable sharing with others. Please do not provide personal data, images or videos that you or they would not want to be publicly available. 

3. Using your information in accordance with the data protection laws

Data protection laws require that we meet certain conditions before we are allowed to use your data in the manner described in this Privacy Policy. We take our responsibilities under the data protection laws extremely seriously. To use your personal information, we will rely on the following conditions, depending on the activities we are carrying out:

a) Legitimate interests
To use your personal data for providing you with information you have requested or with other promotional information or announcements, we will rely on a condition known as "legitimate interests". We will also rely on this condition when processing your information for the administrative and advertising activities described in section 2 (v) and (vi) above, and to conduct the competition and marketing activities described in section 2 (e) above. It is in our legitimate interests to make you aware of developments that we believe are relevant to you or other special offers or updates. It is also in our legitimate interests to collect your information in order for us to provide our services to you more effectively. We will always act reasonably and give full and proper consideration to your interests when balancing them against our legitimate interest, and will only process the minimum data required in order to achieve this legitimate interest;

b) Consent
If you have not contacted us or specifically requested information about our developments, we may provide you with marketing information about our developments where you have provided your consent for us to do so;

c) Performing a contract with you
When you use our website, we will process your personal information to the extent that this is necessary for the performance of our obligations under the Terms and Conditions;
When you reserve and purchase a home, we will process your personal information to the extent that this is necessary for the performance of our obligations under the reservation form, the purchase contract and other terms and conditions provided to you during the process; and
Following the completion of your purchase, we will process your personal information to enable us to provide you with our post purchase customer services. We will process this information to the extent required under our agreement with you. d) Compliance with a legal obligation When you reserve or purchase a home through Miller Homes, we have a legal obligation to undertake anti-money laundering and source of funds checks. In order to comply with this legal obligation, we will process your personal information, including sharing your personal information with third parties who we engage to carrying out anti-money laundering checks on our behalf. 

4. How Does Miller Homes protect your information?

The data protection laws mean that we need to follow strict security procedures in the storage and disclosure of information that you have given us.
When we share your information with trusted third parties, we may do so by email. We do take data security very seriously, but please remember that we cannot guarantee the absolute security of the emails we send.
Where you have registered for a Miller Homes online account, you are responsible for keeping your user name and password confidential.
The information that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our third-party suppliers. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy by imposing mandatory contractual obligations upon the data recipient.
Miller Homes will always aim to ensure that any personal information we keep is as accurate as possible. This may include using third parties to check the accuracy of name and address data.

5. Will Miller Homes disclose the information it collects to third parties?

Miller Homes will not sell, trade or rent your personal information to others for their marketing purposes unless you have given us your permission. We will only share information with carefully chosen, reputable and trustworthy third parties as described in this Privacy Policy. When you reserve and purchase a home, this includes the third parties listed in section 2(c) above. We may also share this information with market researchers.
We may provide aggregate statistics about customers, traffic patterns and related website information to reputable third parties but these statistics will include no personally identifying information.
We may provide you with links to third party websites on our website. If you access those links, you will leave the website. Miller Homes does not control those websites nor their privacy practices.
For personal information provided for the purpose of the First Homes Scheme application, Miller Homes will share this information with the local authority for the purpose of assessing eligibility and obtaining a decision on your application. Miller Homes may also share your personal information with independent financial advisors as part of this process. 
Your personal information may also be shared by the local authority with the UK Government Department for Levelling Up, Housing and Communities, as detailed in the “Your data” section of the First Homes application form. Miller Homes does not control the sharing of information by the local authority and we recommend you review the relevant local authority’s privacy policy to understand how they collect, process and share your data with third parties.

6. Information Retention

Once your details are added to our mailing lists for the purpose of providing you with information about our homes and developments and other general offers and updates, your information will remain on that mailing list: (i) until we receive a request from you to stop contacting you for this purpose; or (ii) if we do not receive a response from you for 12 months. We will not contact you for this purpose again until we hear otherwise from you.
Recorded phone calls are held securely and will be deleted after 1 month.

If you purchase a home from Miller Homes, we will retain your information for 11 years following your purchase. Any information that you provide to us during the process of reserving or purchasing a home for the purpose of conducting anti money laundering and source of funds checks will be retained for 5 years, in accordance with money laundering regulations.

7. Your Rights

Your rights under data protection law in relation to the way we process your personal information are set out below.

You may contact us using the details on our website or using the following email address to exercise any of these rights, and we will respond to any request received from you within one month from the date of the request.

Please address any questions, comments and requests regarding our data processing practices to our Data Protection Manager in the first instance by emailing Miller Homes at DPOffice@miller.co.uk.

a) Access to your personal data
You have a right of subject access. This means that you are entitled to request a copy of your personal information and we will grant you access or provide you with all personal information that we hold about you, subject to some limited exemptions (for example, you will not necessarily be entitled to access third party personal information).

b) Unsubscribe
You can always remove your name and contact details from our various email-lists and other lists. In addition to contacting us in the way noted above, you can ask for your details to be removed from Miller Homes' email-lists permanently on the Contact Preferences section of your Miller Homes online account if you have one.
You can also opt-out of receiving promotional and update emails and SMS by clicking on the unsubscribe option attached to our emails and SMS messages, or by updating your preferences on your Miller Homes online account.

c) Data portability
You have a right of data portability. You are entitled to request that the information you have provided to us is then provided to you (or to another organisation) in a portable, machine readable, electronic format.

d) Rectify your personal data
You have the right to require us to rectify any inaccurate personal data held by us about you.

e) Erase your personal data
You have a right to require us to erase personal data held by us about you. This right will only apply where (for example): we no longer need to use the personal data to achieve the purpose we collected it for; or where you withdraw your consent if we are using your personal data based on your consent; or where you object to the way we process your data (in line with your right to unsubscribe above).

f) Object to or restrict our use of your personal data
You have a right to object to our processing of personal data held by us about you (for example, if you would not like to be subject to any profiling or direct marketing). You may also ask us to restrict the way in which we process your information in certain circumstances (for example, if you think that the information we hold about you is not accurate or we are not processing the data in accordance with section 3 above).

If you have any concerns regarding our processing of your personal data we would be happy to address your query in the first instance. However, if you are not satisfied with our handling of any request in relation to your rights, you also have the right to make a complaint to the Information Commissioner's Office.

Any changes we make to this Privacy Policy in the future will be posted on this page. We will email you to notify you of these changes where we are:
  making substantial changes, or
  doing something with your personal data, which you might not expect based on what we have told you in this Privacy Policy. Otherwise, any updates to this Privacy Policy will be notified to you by a clearly highlighted section on the homepage of our website.
